TL;DR
- You own your content. We make no claim to it.
- Private entries never touch our servers — encryption lives on your device.
- The public feed is opt-in and you can remove your posts at any time.
- Don't use Memoir to harm people or break the law. That's it.
What you can do
You can use Memoir to write a private journal, share memories with family, and read public memoirs from leaders you follow. You own everything you write. We make no claim to your content, encrypted or otherwise.
You may access the public feed from any device and share public posts via standard link sharing without restriction.
What you can't do
- Publish content to the public feed that is illegal, hateful, abusive, or harmful to others — including content that incites violence, harassment, or discrimination.
- Use Memoir to harass, dox, impersonate, or threaten any person.
- Attempt to reverse-engineer, tamper with, or circumvent the encryption protecting other users' data.
- Scrape the public feed at a rate that disrupts service for others. Reasonable personal use is fine; automated mass-harvesting is not.
- Use Memoir to distribute spam, malware, or fraudulent content via the public feed.
The public feed
If you publish a memory to the public feed, you are making it available to anyone with the URL. There is no login, no geographic restriction, no cookies required to read it. You are responsible for the content you choose to publish.
We may remove published content that violates these terms without prior notice. We will make reasonable efforts to notify you via the app when we do. You can unpublish any post at any time from your iOS or macOS device; removal propagates to our servers within seconds.
Our service
Memoir is provided as-is. We work hard to keep the public feed and family-share sync working reliably, but we do not guarantee 100% uptime or error-free operation.
The encryption keys live on your device. If you lose them — for example by wiping your device without a backup — your encrypted data cannot be recovered by us. Keep an encrypted backup via Settings → Backup → Export.
We may update, modify, or discontinue features with reasonable notice. We will never delete or modify your private encrypted data on CloudKit — that is controlled entirely by your Apple ID.
Account and ownership
Memoir does not require an account with us. There is no Memoir user account to create, verify, or delete. Your private data is tied exclusively to your Apple ID and device Keychain.
Your content is yours. By publishing a post to the public feed, you grant us a limited, non-exclusive, royalty-free licence to store and serve that post to the public — for exactly as long as it is published. When you unpublish, that licence ends immediately.
Termination
We may remove public-feed content or suspend a device's ability to publish to the public feed if it repeatedly violates these terms. We do not have the technical ability to terminate your private journal — it lives on your device and in your iCloud account.
You may stop using Memoir at any time by deleting the app. That is the entirety of "termination" on your side.
Liability
To the extent permitted by applicable law, Memoir is provided without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, lost time, or lost profits arising from your use of Memoir.
Our maximum liability for direct damages is limited to the amount you paid for the app in the 12 months preceding the claim. At launch, Memoir is free, so this limit is €0.
Governing law
These terms are governed by the laws of the Netherlands. Disputes will be resolved in the competent courts of Amsterdam, unless mandatory consumer-protection laws in your jurisdiction require otherwise.
Changes
We will update this page when we change anything material and update the date at the top. By continuing to use Memoir after a material change, you accept the revised terms.
For significant changes — such as new data-sharing practices or changes to the public-feed licence — we will provide notice within the app at least 14 days before the change takes effect.
